Welcome to Big Way Rewards! These Terms and Conditions (“Terms”) govern your participation in the Big Way Rewards Program (“Program”) offered by Big Way CA Inc. (“Big Way,” “we,” or “us”). By enrolling in or using the Program, you agree to these Terms.

1. Eligibility
- Open to legal U.S. residents 14 years of age or older.
- If under 18, you must have parent or guardian permission.
- A valid mobile number or email is required for enrollment.

2. How to Join
- Join for free at any participating Big Way location in the U.S.
- Sign up via QR code in-store or through our website or app (coming soon).
- No purchase required to register.

3. Earning Points
- Earn 1 point for every $1 USD spent (before tax and tip) at participating locations.
- Points apply to qualifying purchases made after you’ve joined the Program.
- Occasionally, we may offer bonus point promotions.

4. Redeeming Rewards
Currently, points can be redeemed only for store credit and select official Big Way merchandise. Food or beverage redemptions are not available at this time.
Store Credit
- 200 points = $10 store credit
- 400 points = $20 store credit
Store credit may be applied to in-store purchases, excluding tax and gift cards.
Merchandise (subject to availability and change):
- Tote bags
- Tumblers
- Pens
- Cutlery sets
Merchandise options and point values may vary by location. Items are available while supplies last.

5. Point Expiry & Inactivity
- Points expire 12 months after the date they are earned or on the last day of the year (Dec 31st), whichever is sooner.
- Accounts with no activity for 12 consecutive months may be deactivated, and any unredeemed points forfeited.

Big Way Rewards members may receive:
- Early access to new merchandise drops
- Invitations to exclusive events
- Surprise birthday perks
- Limited-time promotions

7. Account Use & Responsibility
- You are responsible for safeguarding your account and login details.
- Big Way is not responsible for lost, stolen, or misused accounts.
- Points and rewards are non-transferable and have no cash value.
- Points are not refundable or redeemable for cash under any circumstances.

8. Errors & Technical Issues
- Big Way is not responsible for system outages, technical errors, or unintentional point miscalculations.
- We reserve the right to correct any point balance or redemption errors at our sole discretion.

9. Right to Modify or Terminate
- Big Way may change, pause, or terminate the Rewards Program, including rewards, point values, and eligibility requirements, at any time with or without notice.
- Updates will be posted on our website and/or communicated to members.

10. Fraud, Misuse & Termination
We may suspend or cancel your account without notice if:
- We suspect fraud, abuse, or misrepresentation
- You violate these Terms
- You engage in behavior inconsistent with the spirit of the program

11. Force Majeure
Big Way is not liable for any delay or failure to fulfill rewards due to circumstances beyond our control, including but not limited to natural disasters, pandemics, supply chain disruptions, government actions, or labor shortages.

12. Limitation of Liability
To the fullest extent permitted by law, Big Way is not liable for any indirect, incidental, or consequential damages arising from or related to your participation in the Program. In no event shall our total liability exceed the actual value of the points you have earned but not yet redeemed.

13. Privacy
- Your information will be used in accordance with our U.S. Privacy Policy.
- By joining the program, you agree to receive relevant marketing and promotional communications via email or SMS.

14. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the state in which your primary Big Way location resides.
- Any disputes arising out of or relating to the Program shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA), and not in court.
